These Terms of Service ("Terms") form a legally binding agreement between you and TestML, a limited company based in Dublin ("TestML", "we", "us", or "our"). By accessing or using the TestML platform and associated services at testml.org, you agree to be bound by these Terms in full.

Acceptance of Terms
You must be at least 18 years of age to use our services. By creating an account or accessing the TestML platform, you confirm that you meet that age threshold and have the legal capacity to enter into binding contracts under the laws of your jurisdiction.
If you are accessing or using the services on behalf of a legal entity, such as a corporation or limited company, you represent and warrant that you have authority to bind that entity to these Terms. In that case, "you" throughout these Terms refers to that entity.
TestML operates under European Union law and is subject to applicable EU regulations, including the General Data Protection Regulation (GDPR). Access to certain features may be restricted where applicable local law prohibits such use.
Description of Services
TestML provides an enterprise AI testing and evaluation platform built to help organisations validate, monitor, and improve large language model agents prior to and during production deployment. Services available under a valid subscription include:
- End-to-end evaluation pipelines covering 20+ assessment dimensions, including accuracy, safety, latency, cost, and regulatory compliance, delivering full-spectrum evidence on every deployment.
- Proprietary adversarial test suites targeting prompt injection, hallucination exploits, and regulatory boundary violations specific to your enterprise threat model.
- Domain-specific evaluation suites pre-built for legal, medical, financial, and insurance workflows, grounded in real operational and regulatory risk criteria rather than generic benchmarks.
- Continuous production monitoring with automated drift detection and regression testing designed to surface model degradation before it becomes a compliance incident or service failure.
- Multi-agent orchestration analysis and inference cost profiling.
The specific features available to you depend on your subscription tier and any separately negotiated commercial terms. TestML reserves the right to modify, suspend, or discontinue any feature or service component with reasonable notice.
Account and Registration
Access to the TestML platform requires registration and creation of a user account. You agree to provide accurate, current, and complete information during registration and to update that information promptly if it changes.
You are responsible for maintaining the confidentiality of your account credentials, including your password and any API keys issued to you. Notify us immediately at hello@testml.org if you suspect unauthorised access to or use of your account.
Each account may only be used by the individual or legal entity to which it is registered. Sharing credentials across unrelated organisations, or using a single account to serve multiple distinct entities, is not permitted without prior written consent from TestML.
TestML may require additional identity or organisational verification before granting access to certain capabilities, particularly those involving sensitive evaluation datasets or on-premise deployment configurations.
Acceptable Use
You may use the TestML platform only for lawful purposes and in accordance with these Terms. The following are expressly prohibited:
- Attempting to reverse engineer, decompile, disassemble, or derive source code or proprietary evaluation logic from any part of the platform.
- Using automated scripts, bots, or crawlers to scrape, index, or harvest data from the platform without prior written authorisation from TestML.
- Uploading or processing data that infringes third-party intellectual property rights, or that contains defamatory, obscene, or otherwise unlawful material.
- Attempting to circumvent access controls, authentication mechanisms, rate limits, or usage quotas.
- Reselling, sublicensing, or commercialising access to the platform without a separate reseller agreement signed by TestML.
- Using the services to develop or train competing AI evaluation or testing products without prior written consent.
- Submitting false or misleading information to the platform, or misrepresenting your organisational affiliation during registration or any evaluation engagement.
- Taking any action that disrupts the integrity, security, or performance of the platform or its underlying infrastructure.
Violations of this section may result in immediate account suspension and, where appropriate, referral to relevant authorities.
Intellectual Property
All software, documentation, evaluation methodologies, test suites, algorithms, reports, and other content made available through the TestML platform are the exclusive property of TestML or its licensors and are protected by applicable intellectual property law, including copyright, trade secret protections, and database rights under EU law.
Your subscription grants you a limited, non-exclusive, non-transferable licence to access and use the platform for your own internal business purposes during the active term of your subscription. No other rights are granted. You may not copy, modify, distribute, or create derivative works based on any part of the platform or its content without prior written permission from TestML.
If you submit data, evaluation inputs, or other content to the platform ("User Content"), you retain ownership of that content. By submitting User Content, you grant TestML a limited licence to process and store that content solely to provide the services to you. TestML will not use your User Content to train its models or share it with third parties except as required by applicable law or as described in our Privacy Policy.
Any feedback, suggestions, or feature requests you provide to TestML may be used by TestML without restriction or obligation to compensate you, unless a separate written agreement states otherwise.
Disclaimers
The TestML platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, TestML disclaims all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
TestML does not warrant that the platform will be uninterrupted, error-free, or free from security vulnerabilities at all times. Evaluation outputs, red-team findings, drift alerts, and monitoring reports generated by the platform are intended to support your internal engineering and compliance processes. They do not constitute legal advice, medical advice, financial advice, or regulatory certification of any description.
Reliance on evaluation findings for purposes of regulatory submission, legal proceedings, or clinical deployment decisions remains your sole responsibility. Decisions affecting mission-critical workflows should involve qualified professionals in the relevant domain, alongside the evidence our platform provides.
Limitation of Liability
To the fullest extent permitted by applicable law, TestML's total cumulative liability to you for any claim arising from or related to these Terms or your use of the platform, regardless of the form of action, will not exceed the greater of: (a) EUR 100; or (b) the total fees paid by you to TestML in the 12 months immediately preceding the event giving rise to the claim.
In no event will TestML be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, even if TestML has been advised of the possibility of such damages.
Some jurisdictions do not permit the exclusion or limitation of certain categories of damages. Where such restrictions apply under applicable law, the limitations above apply to the maximum extent permitted.
Indemnification
You agree to indemnify, defend, and hold harmless TestML, its officers, directors, employees, and advisors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from: (a) your use of the platform in breach of these Terms; (b) your User Content; (c) your violation of any applicable law or third-party right; or (d) any misrepresentation made by you in connection with your account registration or use of the services.
Termination
TestML may suspend or terminate your access to the platform, in whole or in part, at any time if: (a) you breach any provision of these Terms; (b) we are required to do so by law or a regulatory authority; (c) your subscription lapses or any invoice remains unpaid for more than 30 days after the due date; or (d) continued provision of the services creates material legal or regulatory risk to TestML.
Upon termination, your right to access the platform ceases immediately. The sections covering intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination and remain in full force.
You may close your account at any time by contacting us at hello@testml.org. Termination at your election does not entitle you to a refund of any prepaid subscription fees unless otherwise agreed in a signed order form.
Governing Law and Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of the European Union and the Republic of Ireland, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms, or your use of the platform, will be subject to the exclusive jurisdiction of the courts of Dublin, Ireland.
If you are a consumer resident in another EU member state, you may also have the right to bring proceedings before the courts of your country of habitual residence under applicable EU consumer protection rules.
TestML processes personal data in accordance with GDPR. Full details of how we collect, use, transfer, and protect your data are set out in our Privacy Policy.
Changes to These Terms
TestML may update these Terms from time to time to reflect changes in our services, applicable law, or business practice. When we make material changes, we will notify registered users by email to the address associated with their account at least 14 days before the changes take effect.
Your continued use of the platform after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the platform before the changes take effect and contact us at hello@testml.org to discuss your options.
